Terms of Use | NY Immobilier

1. Purpose and acceptance

These Terms of Use (ToU) govern access to and use of the noyaimmobilier.ci website and related services (website, mobile app, back-office) offered by NY Immobilier in Côte d'Ivoire. By accessing the site, creating an account or using our services (property and land search, visit requests, visit fees payment, furnished residence bookings, favorites, client area), you accept these ToU without reservation. If you do not accept them, please do not use our services.

2. Services offered

NY Immobilier provides: browsing and searching for properties (rent, sale) and land; booking visits and paying visit fees (including via Mobile Money / CinetPay); booking stays in furnished residences; a client area (favorites, visit tracking, profile); for professionals, an agent space and management tools. Listings are for information; availability and actual terms are subject to verification with the NY Immobilier team.

3. User account and registration

For certain features (favorites, visit requests, client area), you must create an account with accurate, up-to-date information. You are responsible for the confidentiality of your credentials and all actions from your account. You agree not to use the site for illegal purposes or contrary to public order and not to infringe third-party rights.

4. Content and listings

Descriptions, photos and prices of properties and land are provided under the responsibility of advertisers and NY Immobilier for the purpose of connecting parties. NY Immobilier strives to verify listing quality but does not guarantee completeness or absence of errors. Contractual commitments (lease, sale) are concluded directly between the parties; NY Immobilier acts as an intermediary and platform.

5. Payments and fees

Visit fees and other amounts due (furnished stays, optional services) are indicated on the site. Online payments (Mobile Money, CinetPay) are subject to the payment providers' rules. In case of a payment dispute, contact us with proof. Any refunds are handled according to our internal policy and the providers' terms.

6. Liability

NY Immobilier uses reasonable means to ensure site availability and security. However, NY Immobilier cannot be held liable for interruptions, data loss or indirect damage. Users use the site at their own risk. NY Immobilier's liability is limited to the amount actually paid by the user for NY Immobilier services in the last twelve months.

7. Intellectual property

The entire site (texts, logos, layouts, software) is protected by copyright and trademarks. Any unauthorized reproduction or use is prohibited. Content you publish (reviews, messages) may be used by NY Immobilier in the operation of the service.

8. Personal data

Personal data processing is described in our Privacy Policy. By accepting the ToU, you acknowledge having read that policy. Your data is used for account management, visits, payments and service improvement, in compliance with applicable law in Côte d'Ivoire.

9. Termination and suspension

NY Immobilier reserves the right to suspend or terminate a user's access in case of breach of these ToU, fraudulent or harmful use, or any legitimate reason. Users may close their account at any time by contacting us. Provisions that by nature must survive termination (liability, intellectual property, governing law) remain in effect.

10. Governing law and contact

These ToU are governed by Ivorian law. Any dispute shall be submitted to the competent courts of Côte d'Ivoire. For any questions: contact@noyaimmobilier.ci. NY Immobilier reserves the right to modify the ToU; users will be informed of material changes (by publication on the site or by email). Continued use after modification constitutes acceptance of the new terms.
